Shipped Semen Contract

(To be executed in duplicate)

This agreement is made and entered into this ____day of ______by Barthel Paint & Quarter 
Horses (BPH) and the mare owner known as ______________________________________. Mare owner agrees to breed the mare________________Reg. No. ____________by transported cooled semen to the stallion____________________________________for the 2005 breeding season and to pay a non refundable stud fee of 
$______.

*Mare owner agrees to pay the stud fee and $200 Collection and shipping fee before shipping semen. A $200 collection and shipping fee will be charged for each shipment of semen.
*BPH prefers to use equitaners instead of disposable containers because of the cost of these containers a $300 deposit is required. Containers must be returned to BPH within 3 days at the expense of the mare owner.
*Mare owner agrees to diligently try to settle the mare. However if the mare does not settle, mare owner will hold BPH harmless for any loss or damage. BPH shall not be liable for any injury, sickness, disease or death of the mare and or her offspring. The mare owner will have no liability to the stallion owner for injury, sickness, or death of the stallion arising from the exercise of the breeding privilege. Insurance for the mare and her offspring is the sole responsibility of the mare owner.
*It is agreed that BPH guarantees a live foal from this mating. Should the foal not stand suck, mare owner will be entitled to a return privilege. If mare does not produce a foal that stands and sucks a fee of $250. plus collection and shipping fee will be charged for rebreed. 
*The mare owner may not assign this breeding contract or substitute any other mare without the consent of BPH.
BPH agrees to diligently try to deliver high quality cooled semen on time. However, it is agreed that BPH will be held harmless in the case where semen is not delivered on time or has lost some of its integrity. BPH should be notified immediately so we can swiftly replace lost or damaged semen.
*It is further agreed that if ________________dies or becomes unfit for breeding this contract shall be null and void. It is also agreed that if mare dies or becomes unfit for breeding mare owner may substitute another mare for $250 plus collection and shipping cost.
